The Guidelines reflect inflationary changes, any new decisions on quantum and any changes in policy. Therefore, in each subsequent edition, the figures will increase from time to time. As there has been two years between the publication of the 13 th and the 14 th edition, the increases will reflect the changes over this two year period. It also continues to include an additional column of figures indicating the 10% uplift in general damages, this was outlined in the Court of Appeal case of Simmons v Castle 2012 . The 10% uplift is included to reflect government reforms which meant that a success fee was no longer recoverable from the third party by the Claimant Solicitors . How much compensation you could be awarded in your claim could be affected by various factors, such as: One of the regular questions that crops up when a Claimant has suffered an injury is ‘How much will I get?’ although the solicitor wants to obtain the best amount of compensation, the answer to the question is not so simple. The new edition to these guidelines is to be welcomed by claimant practitioners as it represents an increase in general damages for various types of injuries as well as the continuing development of this area of the common law. Defendant practitioners prefer to point to the words of the introduction: ‘this is a book of guidelines, not tramlines, and that any award made is the prerogative of the court’.The stated objective of the Guidelines is to achieve consistency across all courts of awards for general damages although they do recognise that damages are for the courts to decide and that the Guidelines are merely that: guidance, not fixed points. In coming to the figures contained within the Guidelines, account is taken not just the rate of inflation since the last Guidelines but also quantum awards made in decisions of the higher courts.
